What is Considered Family Violence in Dallas, Texas?

Family violence, also commonly called domestic violence, under Texas law is defined as an intentional act (or acts) carried out by one family member against or towards another family member, resulting in assault, sexual assault, or bodily injury.

Under Title 4, Sec. 71.004 of Texas Penal Code, family violence is defined as violence that is:

  • Intended to intentionally inflict harm or injury
  • Intended to result in assault or sexual assault
  • Is directed at or towards a family member of the assailant or a member of the assailant’s household
  • Rises to a level that would reasonably instill fear of bodily injury; and/or
  • Is not an act of self-defense against harm (or potential harm) to one’s self

Family Violence and Related Definitions

There is often a lot of confusion around the various legal definitions and terminology relating to domestic violence and what these terms mean for your case.

How is a “Family Member” Defined? – In Texas, any individual related by blood or through marriage, or who is a former spouse is considered to be a “family member”. Further, all parents of the same child, including both foster and step-parents, fall under this definition.

How is a “Household Member” Defined? – For the purposes of domestic violence and the law, a household member is defined as any individual or individuals who either currently or previously live or lived at the same residence as the alleged assailant. This includes any roommates who may or may not be part of the accused’s family by marriage or blood.

What is Dating Violence? – Intentional acts performed or committed against an individual in a relationship by the other party in the relationship, or against an individual they are dating, have seen romantically, or have previously dated, which causes physical or bodily harm.

What is a Protective Order? – Also referred to as a “restraining order”, a protective order is issued by the court in an effort to prevent future violence or harm against the individual filing for the order. Violation of this order is a crime with charges ranging from a misdemeanor to contempt of court. In certain situations, a violation may reach the level of a felony.

What is a Protective Order Hearing? – This is a hearing at which the presiding judge in the Dallas courtroom will review the evidence and make a determination as to whether any harm or violence has occurred and the probability of it re-occurring in the future.
