Is There a Difference Between Assault and Battery in Fort Worth?
Although some other jurisdictions charge assault and battery as two separate crimes, Texas combines the two under one charge. Because of this, each is considered the same as far as charges and penalties.

What Is Considered Assault in San Antonio?
Assault in Texas is classified as either simple assault or aggravated assault, with charges ranging from a Class C misdemeanor to first-degree felony. Penalties for these charges range from fines and fees to life in prison.
Simple assault charges in Texas include conditions such as:
- Intentionally, knowingly, or recklessly taking actions that result in harm or bodily injury to another individual or that individual’s spouse;
- Making threats of bodily injury or harm against another individual or that individual’s spouse; or
- Taking actions with the intent to make physical contact with another individual with the belief or reasonable belief that the individual would regard such physical interaction as offensive or provocative.
While simple assault usually is charged as a misdemeanor in Texas, aggravated assault is charged as a second- or first-degree felony. Penalties for convictions of aggravated assault range from fines greater than $10,000 and prison sentences from 2 years to life.
Factors that are considered when deciding whether aggravated assault charge is warranted include:
- If the victim was a public servant
- Whether or not strangulation was part of the assault
- The relationship of the perpetrator to the victim
- Previous criminal history and/or convictions of the aggressor
Aggravated assault charges may be filed for assaults that:
- Cause or result in serious bodily harm or injury; or
- Involved the use or brandishing of a deadly weapon.
What Is a Battery Charge in San Antonio?
If you are charged or arrested with battery, you are being charged or arrested under the same legal doctrine as assaults. There is, however, a key difference in that battery always involves physical contact or touching that results in bodily damage. With assault, physical touching is not always involved.
While there are no specific thresholds to qualify something as “harm,” you may face more serious penalties for acts that cause more bodily damage (i.e. shooting someone) than those that have less severe consequences (i.e. slapping a person).
