What is Considered Family Violence in San Antonio, TX?
Domestic violence, also commonly placed categorically under “family violence”, is defined under Texas legislation as an intentional act (or acts) made by a member of the family towards another member or members of that family, resulting in an assault, sexual assault or bodily injury or harm.
Under Title 4, Sec. 71.004 of Texas Penal Code, family violence is defined as violence that is:
- Is directed at or towards a family member of the assailant or a member of the assailant’s household
- Intended to intentionally inflict harm or injury
- Rises to a level that would reasonably instill fear of bodily injury
- Intended to result in assault or sexual assault, and/or;
- Is not an act of self-defense against harm (or potential harm) to one’s self
What Types of Relationships Can Family Violence Happen in?
In the state of Texas, the law covers family violence and accusations of family abuse between or among those individuals who are related by either “consanguinity” (blood related) or “affinity”.
Relationships of Consanguinity Include:
- Child and Parent
- Grandchild and Grandparent
- Brother and Sister
- Uncle or Aunt, and Nephew or Niece
Under Texas law, “Affinity” refers to those individuals with whom the person accused of the act or acts is in a relationship with as a result of:
