What is Considered Family Violence in Texas?

Domestic violence and family violence as it pertains to Texas criminal law often involves terminology or definitions unfamiliar to most.

Family Violence: Also known as domestic violence, dating violence or domestic abuse. Defined as the intentional act or acts by one family member towards or against another family member that results in bodily injury, physical harm, sexual assault or assault.

Under Title 4, Sec. 71.004 of Texas Penal Code, family violence is defined as violence that is:

  • Directed towards a member of the assailant’s household or family;
  • Is a threat rising to the level that elicits a reasonable level of fear of bodily injury, physical harm, sexual assault or assault;
  • Meant to intentionally inflict physical injury or harm;
  • Meant to cause assault or sexual assault; and/or
  • Not an act intended to defend one’s self from harm

Dating Violence: Any intentional acts committed by one person in a relationship towards or directed at person they are currently dating or have previously dated, or whom they have seen romantically, that results in any type of bodily or physical harm.

Protective Order: Also known as a “restraining order”, this order is issued by the court as a legal protective remedy to prevent harm or violence against the individual filing for the order. Violation of a protective order may result in penalties ranging from a simple misdemeanor to contempt of court or even a felony in some circumstances.

Protective Order Hearing: A hearing, during which the judge will determine if any violence or harm has occurred and the likelihood of it occurring in the future. The judge will review evidence, including but not limited to witness testimonies in order to make a determination.

Family Member: Under Texas law, any person who is blood-related, related by or through marriage, or who is a former spouse. It also includes any parents of the same child, as well as step and foster parents.

Household Member: As it relates to domestic violence and family violence laws in Texas, a household member is defined as any person or persons who currently or previously reside within the same residence, including any roommates who are not part of the “family”.
